Выявить диалектическую трансформацию доктрины terra nullius в австралийском праве: от инструмента полного отрицания прав коренных народов до формального основания их частичного признания, которое сохранило в современной юридической конструкции (Native Title) системную уязвимость исконных прав, унаследованную от исходной колониальной логики.</p></sec><sec><title>Процедура и методы</title><p>Процедура и методы. В основу исследования положены историко-правовой и сравнительно правовой анализы. Методологическая работа опирается на критический анализ ключевых судебных прецедентов, нормативных и правовых актов австралийских колоний и Австралийского Союза, а также на сопоставлении британского колониального опыта в разных регионах.</p></sec><sec><title>Результаты</title><p>Результаты. Проведённый анализ показал, что правовое положение коренных народов Австралии формировалось в рамках общего права, а при формировании Австралийского Союза было закреплено в Основном законе. Суды, первоначально использовавшие доктрину terra nullius для легитимации лишения прав, в конце XX в. подвергли её ревизии. При этом, разрабатывая новую правовую конструкцию – Native Title, судебная практика опиралась на принцип условности автохтонных прав, что сделало их признание внутренне противоречивым и уязвимым.</p><p>Теоретическая и/или практическая значимость. Выявлен механизм сохранения колониальной логики в рамках её современного отрицания. Представлена критическая оценка ограниченности судебного пути для полноценного восстановления прав аборигенов.</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Aim</title><p>Aim. To examine the dialectical transformation of the terra nullius doctrine within Australian law system: from an instrument of absolute denial of Indigenous rights to a formal basis for their partial recognition. This recognition, enshrined in modern legal construct (Native Title), has preserved a systemic vulnerability inherent in Indigenous rights – a legacy of the original colonial logic.</p></sec><sec><title>Methodology</title><p>Methodology. The study employs historical legal and comparative legal analysis. Methodological work is based on a critical examination of key judicial precedents, normative acts, and legislation from the Australian colonies and the Commonwealth of Australia, as well as a comparative assessment of British colonial experience across different regions.</p></sec><sec><title>Results</title><p>Results. The analysis of the legal status of Indigenous Australians was shaped within the framework of common law and subsequently entrenched in the Commonwealth upon the Federation’s establishment. The courts, which initially utilized the terra nullius doctrine to legitimize deprivation of rights, subjected it to revision in the late 20th century. However, in developing the new legal concept of Native Title, judicial practice relied on the principle of the conditional nature of native rights, rendering their recognition inherently contradictory and vulnerable.</p><p>Research implications lie in identifying the mechanism by which colonial logic is preserved within its contemporary negation.
