Путём анализа юридической практики представлены и обоснованы новые мегатенденции развития трудового права. Автор подчёркивает тот факт, что государство не должно вмешиваться в трудовые отношения на основе директивы. У каждого сотрудника должна быть мотивация эффективного участия в трудовых правоотношениях. Принцип тарифной политики, освобождённый от государственных посягательств, как это сделано в настоящее время в Германии, не нуждается в изменениях, судя по германскому опыту, но должен и может быть заимствован в праве других стран. Автор приходит к выводу, что после существования в XIX в. самостоятельного гражданского общества и в XX в. рабочего общества мы стоим на пороге формирующегося сообщества “занятых” в XXI в.</p></abstract><trans-abstract xml:lang="en"><p>The article reveals the modern structure and basic principles of the German labor law. The author analyzes modern German legislation in the field of protecting the citizens’ labor rights. Based on the analysis of legal practice, new mega-trends in the development of Labor Law have been presented and scientifically substantiated. The author emphasizes the fact that the state should not interfere with labor relations on the basis of the directive. Each person should have a motivation for effective participation in labor relations. The principle of tariff policy established in Germany and freed from state encroachments does not need any alterations, as it has been proved by the German experience, but should and can be borrowed by other countries.
