Цель. Определить содержательные взаимосвязи права на биологическую безопасность и права на неприкосновенность личности, выявить актуальные проблемы теории правопонимания, провести оценку источников права, регулирующих отношения в сфере биологической безопасности.

Процедура и методы

Процедура и методы. В работе использованы общенаучные и специальные методы исследования, в их числе: сравнительно-правовой, диалектический, формально-логический и формальноюридический.

Результаты

Результаты. Раскрыты содержание права на биологическую безопасность, его взаимосвязь с правом на биологическую неприкосновенность; отмечены принципы права, которые необходимо учитывать при развитии правового содержания биологической безопасности.

Теоретическая и/или практическая значимость. Результаты исследования вносят вклад в теорию конституционного права, создавая предпосылки для развития доктрины прав нового поколения в системе охраны здоровья, обеспечения населения безопасной окружающей средой.

Aim

Aim. To determine the meaningful relationships between the right to biological safety and the right to personal integrity, to identify current problems in the theory of legal understanding, and to assess the sources of law regulating relations in the field of biological safety.

Methodology

Methodology. The work used general scientific and special research methods. These include comparative legal, dialectical, formal logical and formal legal.

Results

Results. The content of the right to biological safety, its interrelation with the right to biological integrity is revealed. The principles of law that should be taken into account in the development of the legal content of biological safety are noted.

Research implications

Research implications. The results of the study contribute to the theory of constitutional law, creating the prerequisites for the development of the doctrine of a new generation of rights in the health care system, providing the population with a safe environment.
